Prendre au sérieux la Charte des droits fondamentaux en droit des étrangers

Abstract : Five years after its entry into force on 1 December 2009, the Charter of Fundamental Rights does not lack to be apply in cases of immigration law when the matter at issue is in the field of the EU law. The results of its application is still halftone. If its use in decisions on the migrants right’s or asylum is increasingly common, the Luxembourg Court has never defined the general principles governing its application to non-EU citizens. The use of the Charter in immigration law seems to be essentially a confirmation of the jurisprudence of the ECHR. By contrast there is a more constructive and independent jurisprudence concerning the asylum law which could benefit third country nationals.
