Protection de la personne en curatelle, liberté matrimoniale ou droit au mariage : l’approche interne confrontée à l’approche européenne

Abstract : By deciding that article 460 of the Civil Code, which subordinates the marriage of a ward to an authorisation, in conformity with the Constitution, the Constitutional Court has conceived marriage solely as a status, comprising personal and property obligations, without particularly protecting its personal aspect. The loss of control over financial realities by a protected person, is apt to constitute, in civil caselaw, a dertermining factor in the appreciation of the capacity to consent to marriage, contrary to some other European laws. The internal approach to matrimonial liberty and the limitations to matrimonial liberty of a person under partial guardianship, call for a confrontation with the European Court of Human Rights' approach, in the field of right to marriage and the protection of vulnerable persons due to mental disorders.
