Sentiments et droits de l’homme : Philosophie des sentiments moraux et jurisprudence de la Cour européenne des droits de l’homme

Abstract : Integrated in the European Court of Human Rights’ control, the taking into consideration of feelings needs to be examined. Feeling constitutes a common characteristic of humanity, arising from an assessment based on objective circumstances, like that operated by Adam Smith’s « impartial spectator ». The status analysis of feelings in case-law extends itself through the determination of the place reserved to feelings.
