L’autonomisation relative des références à la sécurité dans les décisions du Conseil constitutionnel

Abstract : Are there specific references to security in French Constitutional Council decisions? Do these references include a process of automatization of a fundamental right to security that can be detected elsewhere? To give an unequivocal answer to these questions is not easy. The decisions of the French Constitutional Council present complex references to security. Although the French Constitutional Council never consecrated a fundamental right to security at the constitutional level, it allows the Parliament to do it at the legislative level. Moreover, in the same way as the latter, it considers security as a condition for the implementation of other constitutional rights and freedoms.
