« Le Tribunal arbitral du sport, juge administratif global ? », Dossier : la globalisation du droit administratif
Résumé
The Court of Arbitration for Sport as a "global administrative judge" can be seen in two ways, depending on whether the emphasis is placed on the "administrative" or the "global" aspect. On the one hand, the CAS would be similar to an administrative judge, in the functional sense of the term (working in the global sphere), while on the other hand it would present itself as a global regulatory body (participating in the dissemination of administrative-type standards). Thus, the analogy between the CAS and the administrative judge, which will be an opportunity to envisage a form of globalisation of administrative law, will be followed by the transposition of the doctrine of "global administrative law" to the CAS - it will then be more a question of the "administrativisation" of global (sports) law.
Le Tribunal arbitral du sport en tant que « juge administratif global » peut être envisagé de deux manières, selon que l’accent est placé sur l’aspect « administratif » ou sur l’aspect « global ». Le TAS s’apparenterait d’une part à un juge administratif, au sens fonctionnel du terme (œuvrant dans la sphère globale), quand d’autre part il se présenterait comme un organe de la régulation globale (participant de la diffusion de normes de type administratif). Ainsi, à l’analogie entre le TAS et le juge administratif, qui sera l’occasion d’envisager une forme de globalisation du droit administratif succédera la transposition au TAS de la doctrine du « droit administratif global » – il sera alors davantage question d’administrativisation du droit (sportif) global.
