LA LEX SPORTIVA - RECHERCHE SUR LE DROIT TRANSNATIONAL

Abstract : Based on the notion of transnational law, this PhD thesis analyses the self-regulation of the transnational sport movement. It shows that lex sportive is made of the various legal systems of the international federations, which the legal order of the International Olympic Committee tends to centralise, assisted by the activities of the Court of Arbitration for Sport and the World Anti-Doping Agency. The thesis then evaluates the degree of autonomy of lex sportive. Largely liberated from national rules and badly framed by a too decentralized international legal system, lex sportive is nevertheless substantially limited by European law.
